OVERVIEW

Welcome to AniRepel! The terms "we", "us" and "our" refer to AniRepel. AniRepel operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). AniRepel is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

 

Please read these Terms carefully. They explain the difference between a Pioneer reservation and a later device purchase. Nothing in these Terms limits rights that cannot legally be excluded.

 

These Terms apply to your use of the store and to transactions you complete with AniRepel. Our Privacy Policy explains how personal data is handled.

 

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

 

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

 

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

 

SECTION 2 - PRODUCTS AND PIONEER STATUS

The device images and prices shown during the reservation phase are preliminary estimates. Pioneer Batch #1 has not yet been produced. Before any final device purchase, we will provide the confirmed product details, regular launch price, estimated delivery timing and the information needed to decide whether to buy. The appearance, components and specifications of the final device may differ from current prototypes; any material changes will be communicated before the final purchase decision. A reservation alone does not oblige you to buy a device.

AniRepel Base and Pro are planned Pioneer devices. Optional Pet Recognition uses a collar tag. Product features and limitations for the final purchase will be described in the offer available before you confirm that purchase. Your statutory rights and any express warranty are unaffected by the Pioneer designation.

SECTION 3 - RESERVATIONS AND FINAL DEVICE PURCHASES

A Pioneer reservation is a separate transaction for priority access, not an order for or pre-order of a device. The reservation payment is charged when you complete the reservation checkout. It does not automatically trigger a later charge or shipment of a device.

You may cancel the reservation at any time before separately confirming a final device purchase and receive a full refund of the amount you actually paid. The same refund applies if you decline the later purchase offer or if we cannot ship to your destination. Details are set out in our Return and Refund Policy.

If you choose to buy a device later, you will receive a separate offer and checkout. You can review your final configuration and total payable amount before confirming that purchase. The final device purchase is subject to the product details and terms presented at that time, together with applicable statutory rights.

SECTION 4 - PRICES, PIONEER BENEFITS AND DESTINATION COSTS

The device and accessory prices shown at the reservation stage are estimates and may change before the final purchase. Your reservation secures a 20% Pioneer discount on the confirmed regular launch price of your reserved AniRepel Base and Pro devices. Accessories, including Pet Recognition collar tags, are not discounted under this offer. We will also credit the full amount you actually paid for your reservation toward the final purchase in the same currency in which you paid it. The credit is separate from the device discount.

Before you decide whether to make the final device purchase, we will provide the confirmed device price, calculated shipping costs and applicable taxes. Additional import duties or charges may apply depending on the destination; we will clarify the arrangements for your destination before that decision. A reservation is not a guarantee that we can deliver to every destination. If delivery to your destination is unavailable, we will refund the reservation payment in full. No additional device payment is collected without your separate confirmation.

SECTION 5 - SHIPPING AND DELIVERY

No device is shipped as a result of the reservation alone. The final delivery estimate and shipping arrangements will be communicated before the separate device purchase. Once a device purchase has been confirmed, we will provide shipping information and available tracking details when the device is dispatched. If a delay occurs, we will inform you and handle your rights under applicable law and the confirmed purchase terms. Risk of loss or damage passes in accordance with applicable law; where mandatory consumer rules require it, this is when you or a person designated by you receives the goods.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, text, displays, images, graphics, product reviews, video, audio, and design, are owned by AniRepel, its affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, or exploit any material without our prior written consent. AniRepel's names, logos, designs, and slogans are trademarks of AniRepel.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. Use of such tools is entirely at your own risk.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating their content and assume no liability for any harm or damages related to third-party sites.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

AniRepel is powered by Shopify. However, any sales and purchases you make are made directly with AniRepel. AniRepel is the seller responsible for its transactions with you. Shopify provides the ecommerce platform. This does not limit any rights you may have under applicable law.

SECTION 10 - PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy and Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

SECTION 11 - FEEDBACK

If you voluntarily submit feedback or a review, you allow us to use it to improve our products and services. We will ask for separate permission before using identifiable personal content, images or testimonials in public marketing. Our Privacy Policy applies to personal data.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

If we identify a material error in a product description, price, promotion or availability, we will notify affected customers and address the error in accordance with applicable law. Corrections do not remove the expressly promised Pioneer device discount or the right to a full refund of an eligible reservation.

SECTION 13 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You agree not to violate any laws, infringe on intellectual property, transmit malware, use automated scraping/AI tools to extract data without authorization, or interfere with security features of the store.

SECTION 14 - AGENTS

Automated access must not interfere with the store, bypass security measures or misuse customer information.

SECTION 15 - TERMINATION

We may restrict access to the store where reasonably necessary to protect the service or comply with law. This does not remove existing reservation refund rights, confirmed purchase obligations or statutory rights.

SECTION 16 - OUTDOOR USE AND RECOGNITION LIMITATIONS

AniRepel is intended for outdoor garden use with a compatible pressurized garden hose. Follow the installation, maintenance, storage and temperature instructions supplied with the final device. Water-containing parts may be damaged by freezing; disconnect, drain and store the device as instructed when frost is expected.

The Pro model's local human recognition and optional BLE Pet Recognition are designed to reduce unwanted activations, but recognition may vary with lighting, weather, distance, movement, obstructions, interference and battery condition. They are not safety systems and should not be relied upon to prevent every activation. The final product information and user instructions will specify the applicable operating limits. These explanations do not exclude rights relating to a defective or incorrectly described product.

SECTION 17 - LIABILITY AND WARRANTY RIGHTS

AniRepel is responsible for its obligations under the confirmed transaction and applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or restricts statutory consumer rights, including rights concerning faulty or misdescribed goods. Any express two-year limited Pioneer device warranty will be provided with its full terms before the final device purchase and is additional to, not a replacement for, mandatory statutory rights. A reservation payment itself does not purchase the device warranty.

SECTION 18 - CUSTOMER RESPONSIBILITIES

You must provide accurate information needed to process a reservation or later purchase and use any purchased device in accordance with its instructions. Responsibility for damage caused by misuse or improper installation is determined under applicable law and the circumstances of the case; these Terms do not impose a blanket indemnity for all claims.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

These Terms, our policies and the details confirmed for an individual reservation or later device purchase govern the relevant transaction. A specific confirmed offer takes precedence over general wording here where the two differ. Mandatory statutory rights remain unaffected.

SECTION 21 - ASSIGNMENT

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent.

SECTION 22 - GOVERNING LAW

Swiss law governs these Terms to the extent permitted by applicable law. This choice does not deprive consumers of mandatory protections that apply in their country of habitual residence.

SECTION 23 - HEADINGS

The headings used in this agreement are included for convenience only and will not limit or affect these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time on this page. We may update these Terms for future use of the store. A change posted after your reservation or purchase does not retrospectively remove an agreed Pioneer benefit, an accrued refund right or a mandatory statutory right.
